Who Is Santander Consumer USA
Santander Consumer USA is an auto finance company base in Dallas, Texas. The company specializes in offering subprime auto loans to consumers with lower credit scores. Santander purports to help credit-challenged consumers obtain auto financing and "partnering with them to improve their overall financial well-being."
In reality, rather than helping, Santander actually preys on these consumers. The truth is Santander intentionally sets up buyers to fail. Why? Because when the buyer fails, Santander can actually make more money than if the buyer had paid their loan in full. Santander has been exposed as a predatory lender who colludes with their dealership partners to mislead credit-challenged consumers and trick them into signing high-cost loans on used cars.
DECEPTIVE PRACTICES AND COMPLAINTS
Santander Consumer USA has faced numerous legal challenges due to its business practices in the subprime auto loan industry. The company, a major player in originating and servicing auto loans for borrowers with less-than-perfect credit, has been accused of engaging in deceptive and predatory practices. These allegations have led to significant federal and state lawsuits, regulatory penalties, and consumer complaints.
In 2020, Santander settled with a coalition of 34 state attorneys general, agreeing to pay $550 million in relief to consumers. The settlement followed allegations that Santander knowingly placed borrowers into loans they were unlikely to repay. The company was accused of inflating borrowers’ income and failing to monitor dealer practices, resulting in high default rates and repossessions.
The Consumer Financial Protection Bureau (CFPB) also penalized Santander $4.75 million for violating the Fair Credit Reporting Act. Santander was found to have provided inaccurate information to credit reporting agencies and failed to correct errors, which harmed consumers’ credit scores.
Common Violations Alleged in These Lawsuits:
-
Issuing loans to subprime borrowers who were unlikely to afford them
-
Failing to monitor dealerships who misrepresented loan terms
-
Overcharging for fees not included in contracts, such as convenience fees and processing fees
-
Harassing consumers with unsolicited, automated robocalls, violating federal collection laws
-
Providing inaccurate information to credit reporting agencies, negatively impacting consumer credit scores
Santander’s repeated violations highlight the importance of consumer awareness and advocacy when dealing with lenders in the auto loan industry. If you believe your rights have been violated, you may benefit from a free consultation, contact Boe & Associates today.
Are you being sued by Santander Consumer USA?
Did you know Santander's business model is based on the expectation that the borrowers they lend to will default on their loan? They actually expect you will fail because when you do, they can collect even more money from you. And when their borrowers default, their tactic is to sue them in court. Santander knows that most consumers in this situation will not show up in court and fight, which means Santander will receive a default judgement that they can use to garnish wages, place a lien on borrower's homes or other property, or attempt to collect in some way for years; and in some states, the law allows them to attempt to collect on the judgement for decades.
If the lawsuit is currently open, we may be able to help you turn the tables on Santander, BUT...
You must ACT FAST! We have a very short window of time in which we may be able to help you. So contact us TODAY!

Was your vehicle repossessed by Santander Consumer USA?
Repossessing a vehicle is another way Santander expects to generate more revenue. Santander can take your vehicle after you've defaulted on the loan, sell it at auction - and in most cases a vehicle at auction sells way below what you owe on the debt - and tack on additional fees and expenses to your remaining debt. You still are responsible to pay the balance of the loan AND now you pay them even more because you have to pay the charges related to the repossession.
This is an unfair and deceptive business practice. If this was your experience...

Did the dealership inflate your income or misrepresent your financial stability in order to secure a loan approval?
Santander's dealership partners have been accused of pushing borrowers into overpriced vehicles and then inflating their income - misrepresenting the borrower's ability to repay the auto loan in order to secure loan approvals.
In reality, this practice pushed consumers into loans with unfavorable terms which lead to borrowers receiving loans they could not afford to repay. These borrowers eventually defaulted and their vehicle was repossessed.

Were you told you need to purchase add-on products like GAP insurance or an extended warranty to get approved?
Borrowers have said that they were required to purchase costly add-on products like GAP insurance and extended warranties in order to get their Santander loan approved. And worse, some borrowers stated the dealerships added these products without their knowledge and informed consent.
These are unfair and deceptive business practices. If this was your experience...
