St. Paul, MN –Today, Boe & Associates was instrumental in helping to secure the dismissal of a debt collection lawsuit initiated by Midland Credit Management, Inc. against one of the firm's clients.
This decision puts an end to the harassment and distress the consumer has had to endure over the past two years while Midland Credit Management attempted to collect this alleged debt. Once Midland filed suit against the client, she sought the assistance of Boe & Associates. Boe & Associates provided the consumer with education and services that helped to secure a victory for the consumer.
Midland Credit Management, along with its parent company, Encore Capital Group, Inc., and its sister companies, Midland Funding, LLC, and Asset Acceptance Capital Corp are headquartered in San Diego, California and together make up the largest debt collector and debt buyer in the United States, with annual revenues exceeding $1 billion and annual net income in excess of $75 million.
These companies have a long history of abusive debt collection practices which have violated the Consumer Financial Protection Act (CFPA), Fair Debt Collection Practices Act (FDCPA), and the Fair Credit Report Act (FCRA). They have previously been sued by the Consumer Financial Protection Bureau (CFPB) as well as several state attorney generals for their abusive practices. In 2015, the CFPB secured a consent order that required the companies to pay millions in penalties and restitution as well as abide by certain conduct provisions.
In 2020, the companies were again sued by the CFPB for failing to abide by the 2015 consent order as well as continuing to violate federal consumer protection laws. The companies were once again required to pay millions in penalties and redress; however, it does not seem as if the penalties are a deterrent to the companies. Could it be they make so much money, that they would rather continue their abusive practices and pay the fines than follow the law?
